New Delhi: The Supreme Court on Monday warned that perpetrators of ‘honour killings’ could face death penalty, saying the crime meets the “rarestof-rare” criterion laid down by it to award capital punishment.
“All persons who are planning to perpetrate ‘honour killing’ should know that the gallows await them,” said a bench of Justices Markandey Katju and Gyan Sudha Misra after upholding the conviction and sentence of one Bhagwan Dass, who killed his daughter for deserting her husband and eloping with an uncle.
Dass, infuriated by his daughter’s incestuous relationship with her own uncle after walking out on her husband, murdered her by strangling her with a wire.

At first glance, the SC’s view might appear strange. How can something that has become so frequent be categorized among the rarest-of-rare cases? However, the court is right in not treating that principle as a statistical concept. If the idea behind retaining the death penalty is to deter, honour killings must count among the crimes most urgently in need of deterrence. Killing to enforce a mediaeval code of conduct undermines the very basis of the rule of law as set down by the Constitution. It, therefore, deserves the toughest penalty.

Honour killings are barbaric: SC


New Delhi: The Supreme Court on Monday said honour killings are barbaric, and they should be stamped out. Upholding the conviction of a man who had killed his daughter for incestuous relationship, the apex court said, “In our opinion, honour killings, for whatever reason, come within the category of rarest of rare cases deserving death punishment.”
“It is time to stamp out these barbaric, feudal practices which are a slur on our nation. This is necessary as a deterrent for such outrageous, uncivilised behaviour. All persons who are planning to perpetrate honour killings should know that gallows await them,” the Supreme Court said.
“We would like to state that honour killings have become commonplace in many parts of the country, particularly in Haryana, western Uttar Pradesh and Rajasthan. Often young couples who fall in love have to seek shelter in the police lines or protection homes to avoid the wrath of kangaroo courts,” the bench said.
